  • Commercial Art & Client Production: You are fully authorized to sell, monetize, exhibit, or license visual artworks generated through your personal execution of our prompt formulas without paying royalties or licensing fees to Thomox.

C. Express Prohibitions on Content Scraping & Republication

Notwithstanding the creative license above, you are strictly prohibited from:

  1. Systematically scraping, copying, harvesting, or aggregating our written editorial explanations, articles, tutorials, or guides using automated web crawlers, bots, or extraction scripts.
  2. Operating a competing prompt directory, database, or mirror website that republishes substantial portions of our curated prompt formulas and editorial text.
  3. Representing, claiming, or implying that Thomox’s proprietary written analyses, editorial breakdowns, or custom branding are your own creation.

4. User Submissions, Comments & Community Conduct

Whenever you submit feedback, creative suggestions, tutorial comments, or proposed prompt formulas to Thomox (collectively, “Submissions”), you acknowledge and agree that:

  • Your Submissions are non-confidential and non-proprietary.
  • You warrant that you own or possess the necessary rights, licenses, and permissions to supply such Submissions without infringing upon any third-party intellectual property or privacy rights.
  • You grant Thomox an irrevocable, perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your Submissions across our digital properties for educational and editorial purposes.
  • We reserve the absolute right, without obligation, to screen, monitor, edit, refuse to publish, or remove any user comment or submission that we deem, in our sole discretion, to be offensive, defamatory, spammy, or in violation of these Terms.

5. Strictly Prohibited Activities

In accessing and utilizing Thomox Prompts, you explicitly agree not to engage in any of the following prohibited behaviors:

Thomox Prompts contains references and hyperlinks directing users to external third-party tools, cloud compute platforms, and software frameworks (including Midjourney, OpenAI, Hugging Face, GitHub, and Google). You acknowledge and agree that:

Thomox does not control, supervise, endorse, or guarantee any third-party platform. Your utilization of third-party generative tools is subject strictly to the respective terms of service and licensing contracts established by those independent providers. Thomox bears zero responsibility or liability for any billing disputes, account terminations, model deprecations, or data breaches experienced on third-party websites.

7. Disclaimer of Warranties (“As-Is” Provision)

THE WEBSITE AND ALL PUBLISHED MATERIALS ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO THOMOX DURING THE SIX (6) MONTH PERIOD PRECEDING THE CLAIM, OR FIFTY UNITED STATES DOLLARS ($50.00 USD), WHICHEVER IS LESS.

You agree to defend, indemnify, and hold harmless Thomox Prompts, its subsidiaries, affiliates, officers, agents, partners, and employees from and against any loss, damage, liability, claim, or demand (including reasonable legal fees and expenses) made by any third party due to or arising out of:

Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved exclusively through the competent courts located in Kuala Lumpur, Malaysia, and you hereby consent to personal jurisdiction therein.

12. Severability, Entire Agreement & Waiver

These Terms and Conditions, together with our Privacy Policy and Legal Disclaimer, constitute the entire agreement and understanding between you and Thomox Prompts regarding the Website. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
